1. Who we are & what you're agreeing to

These Terms of Service ("Terms") are a binding agreement between you and mwahhh ("mwahhh", "we", "us") governing your use of the mwahhh mobile application, the mwahhh.com website, and all related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy and Content Guidelines, which are incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility — adults only

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use mwahhh. By using the Service you represent and warrant that you meet this requirement. We may suspend or terminate accounts we reasonably believe belong to minors, without notice or refund.

3. The Service is fiction

mwahhh is an entertainment product. Every character on the Service is a fictional persona whose messages, voice notes, photos and other content are generated by artificial intelligence. Characters are not real people, and nothing they say is written by a human in real time.

• Characters do not have feelings, and no real relationship is formed, offered or implied.
• Character content is not advice. It is not medical, psychological, legal, financial or professional guidance of any kind, and you should not rely on it as such.
• mwahhh is not a substitute for human relationships, therapy or mental-health care. If you are struggling, please reach out to a qualified professional or a local support line.
• AI-generated content can be inaccurate, inconsistent or unexpected. We do not guarantee that any particular content will be generated or retained.

4. Your account

You need an account to use most of the Service. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your account. You may not share, sell or transfer your account. We may suspend or terminate your account if you violate these Terms.

5. Subscriptions, virtual items & payments

Parts of the Service are free; others require payment.

• Purchases go through your app store. Subscriptions and in-app purchases are processed by Apple's App Store (or another platform where the app is distributed), under that platform's payment terms. We do not receive or store your card details.
• Subscriptions auto-renew until cancelled. You can cancel anytime in your device's subscription settings; cancellation takes effect at the end of the current billing period.
• Virtual currency and items (such as coins, unlocks and premium dates) are licensed to you, not sold. They have no monetary value, cannot be exchanged for cash, and are non-transferable and non-refundable except where the law requires otherwise.
• Refunds are handled by the app store platform under its policies. If you believe you were charged in error, contact the platform first, then [email protected] if you still need help.
• We may change prices or what's included in free and paid tiers; changes apply from your next billing period onward.

6. Acceptable use

You agree not to:

• use the Service if you are under 18, or make it available to anyone under 18;
• attempt to generate content that is illegal, that sexualises minors in any way (zero tolerance — accounts are terminated and reported), or that promotes violence, self-harm or hatred;
• harass real people through the Service, or use it to impersonate, stalk or harm anyone;
• reverse-engineer, scrape, data-mine, or use automated tools to access the Service, or attempt to extract our models, prompts or character material;
• resell, sublicense or commercially exploit the Service or its content without our written permission;
• circumvent rate limits, payment requirements, safety filters or other technical protections.

See the Content Guidelines for more detail on what's allowed. We may moderate, restrict or remove content and accounts at our discretion to keep the Service safe and lawful.

7. Your content & our content

Your content. You retain ownership of the messages and other material you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce and use it as needed to operate, improve and protect the Service (for example: generating character replies, storing conversation memory, and safety moderation).

Our content. The Service — including all characters, their names, personalities, backstories, artwork, voices, the mwahhh brand, software and generated content — is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial entertainment. Characters and their content may not be used outside the Service without our written permission.

8. Termination

You can stop using mwahhh and delete your account at any time. We may suspend or terminate your access (with or without notice) if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination your license ends and unused virtual items are forfeited, except where the law says otherwise.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that any content (including memory of past conversations) will be preserved.

10. Limitation of liability

To the fullest extent permitted by law, mwahhh and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) €50. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.

12. Changes to the Service or these Terms

We're actively building mwahhh — features, characters and content will change, and we may modify or discontinue parts of the Service. We may also update these Terms; if changes are material we'll give you reasonable notice (for example, in-app or by email). Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Governing law & disputes

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania — except that consumers in the EU/EEA retain any mandatory protections and venue rights of their country of residence. EU consumers may also use the European Commission's online dispute-resolution platform.
